“黑中介”涉恶势力及罪名探析

摘　　要：认定恶势力犯罪要严格按照最高人民法院、最高人民检察院、公安部、司法部联合出台的指导意见,区分其与黑社会性质犯罪的本质差异,在程度上严格把握恶势力认定标准,谨防误断误判,又要避免对指导意见理解不深、参悟不透而怯于认定,放任恶势力犯罪的猖獗。大概念语境下恶势力犯罪多发于财产类犯罪、妨害社会管理秩序类犯罪及侵犯公民人身权、民主权类犯罪。尤其在财产类犯罪案件中,行为的复杂性导致罪名认定如鲠在喉,需结合犯罪构成要件、行为间微妙关系等综合解构罪名间差异。The cognizance of evil force crime should strictly follow the guidance jointly issued by the Supreme People's Court,the Supreme People's Procuratorate,Ministry of Public Security and the Ministry of Justice.To distinguish the essential difference between it and gangland crime,we should strictly grasp the identification standard of evil forces to the extent,guard against misjudgment,and avoid being afraid of identification without deep or thorough understanding of the guiding opinions,allowing evil forces to commit rampant crimes.In a wider concept,evil force crimes usually occurs in crimes attached with property,social order or personal right.Especially in the property crime cases,the complexity of the behavior leads to the difficulty in determining the charges.Therefore,the differences between the charges should be deconstructed comprehensively by combining the elements of the crime and the subtle relationship between the behaviors.
