涉黑案件证人保护制度探究

摘　　要：自2018年开展扫黑除恶专项斗争以来,涉黑案件数量大量增加。涉黑案件中证人是否积极作证是影响案件进程和办案成效的重要因素。由于涉黑案件所具有的隐蔽性高、暴力性大和组织性强等区别于一般犯罪的特点,涉黑案件证人所面临的危险相较于一般证人会更大,因此所采取的保护措施也应有所差异。具体而言,结合我国当前立法司法实践,从涉黑案件证人保护类型应当予以区分,在加强对涉黑案件证人事前预防保护,注重涉黑案件证人人格保护,扩大涉黑案件证人保护范围,构建污点证人的特别保护机制,规范涉黑案件证人保护程序,防范公权力的内部侵害,形成完善的涉黑案件证人保护机制。Since the launch of the special crackdown campaign of underworld society related crimes in 2018,the number of cases involving underworld society has increased rapidly.Whether the witnesses in such cases are active to testify is an important influencing factor for the proceeding and effectiveness of case handling.Due to the case characteristics of deep concealment,much violence and strong organization,which are different from ordinary crimes,the danger faced by witnesses in underworld society related cases are greater than that of ordinary witnesses,so the protection measures adopted are also different.Specifically,in light of China's current legislative and judicial practices,it needs to strengthen the preventive protection of witnesses,emphasize the protection of witness personalities,expand the protection scope of witnesses,establish a special protection mechanism for tainted witnesses,standardize the witness protection procedures,prevent the internal violations by public power,and form a perfect mechanism of witness protection in underworld society related cases.
