摘　　要：因公益需要提前收回海域使用权属于行政征收中的公益征收。在提前收回海域使用权行政补偿案件中,起诉人与提前收回海域使用权行政补偿行为之间具有利害关系,是审查认定原告资格的核心要求;适格被告应确定为批准用海的县级以上人民政府;作为法定收回事由的“公共利益”主要涉及免缴海域使用金的用海项目,部分涉及重要国计民生利益的减交海域使用金的用海项目等。应依法重点审查补偿程序中公告与通知等环节,通过确认违法和撤销补偿决定等方式,审查监督行政机关正确履行程序要求。对海域使用权的行政补偿以直接补偿中的金钱补偿为主;涉及具体养殖的,应结合养殖品类及当地实际情况确定补偿标准;补偿范围限于权益人的财产损失,可适当考虑海域使用权人未来需要抵御的风险等因素。Withdrawing the right to use sea areas in advance due to the need for public welfare belongs to public welfare collection in administrative collection.In the cases of administrative compensation for withdrawing the right to use sea areas in advance,the prosecutor has an interest relationship with the administrative compensation for withdrawing the right to use sea areas in advance,which is the core requirement for reviewing and determining the qualifications of the plaintiff;the eligible defendant should be determined to be the people’s government at or above the county level approved to use the sea;the“public interest”as a statutory reason for withdrawal mainly involves sea-use projects that are exempt from payment of funds to use sea areas,and some sea-use projects reduced the payment of funds to use sea areas that are important for the national economy and the people’s livelihood.In accordance with the law,it is necessary to focus on reviewing the announcements and notices in the compensation procedures,to review and supervise the correct fulfillment of the procedural requirements by the administrative agencies by confirming violations and canceling compensation decisions.The administrative compensation for the right to use sea areas is mainly based on monetary compensation in direct compensation;for specific breeding,the compensation standard should be determined based on the type of aquaculture and the actual local conditions;the scope of compensation is limited to the property loss of the right holder,and appropriate consideration may be given to the holder of the right to use sea areas about the factors such as risks that need to be resisted in the future.
