疫情期间健康码发放行为的可诉性分析

摘　　要：对于日常生活必不可少的健康码,其发放行为应经受合法性的审查。从法律属性来看,行政机关发放健康码可归属于行政行为,在具体行政行为类型上可归属于行政确认行为。健康码发放行为会对相对人的权利义务产生实际影响,且因错误健康码造成的侵益性后果缺乏法定救济途径的情况下,健康码发放行为被确认可诉具有正当性和必要性。行政机关作为健康码发放算法程序的实际控制者,应对因错误健康码造成的侵益性后果承担相应的法律责任。Since health codes are indispensable in daily life,the action of issuing health codes should undergo legal review.From the perspective of legal attributes,the issuing of health codes by administrative agencies can be attributed to administrative actions,and in terms of specific types of administrative actions it can be attributed to administrative confirmation actions.In the case that the issuing of health codes has a practical impact on the rights and obligations of the counterparty,and there is no legal remedy for the intrusive consequences caused by wrong health codes,it is justifiable and necessary that the issuing of health code is confirmed as justiciable.As the actual controller of the health code issuing algorithm program,the administrative agency shall bear corresponding legal responsibility for the intrusive consequences caused by wrong health codes.
