科技成果转化中高校的权利义务探析——以中美相关法律比较为视角

摘　　要：第四次《专利法》第6条通过设置专利权利再分配的条款完善了我国科技成果权属制度。虽然我国高校对科技成果享有所有权、自主转化权和收益权,但是基于中美相关法律的比较后发现我国高校的义务规定仍不甚明确,不能体现权利义务一致性的要求。高校科技成果转化中权利义务规范的完善可从以下两方面着手。第一,增设意思自治的权益再分配程序可以更好地契合第四次《专利法》第6条和第15条规定的职务发明制度;第二,完善义务规范,包括明确科技成果转化的义务主体,充实报告义务的内容以及增设未履行收益分配义务的责任。Article 6 of the fourth Patent Law improves the ownership system of scientific and technological achievements by setting up the provision of redistribution of patent rights.Although China‘s colleges and universities have the ownership,independent transformation right and income right of scientific and technological achievements,based on the comparison of relevant laws between China and the United States,it is found that the obligation provisions of China’s colleges and universities are still not very clear,which can not reflect the requirements of consistency of rights and obligations.The perfection of the norms of rights and obligations in the transfer of scientific and technological achievements in universities can be started from the following two aspects.Firstly,adding the right selection procedure of party autonomy can better conform to the service invention system of Article 6 and Article 15 of the 4th Patent Law;Secondly,it is necessary to improve the standard of obligations from the legislation,including defining the subject of the obligation of transfer of scientific and technological achievements,enriching the content of the standard of reporting obligations and adding the responsibility of failing to fulfill the obligations of income distribution.
