上诉请求拘束原则的适用——兼评“劝阻吸烟猝死案”

摘　　要：上诉请求是上诉审的诉讼标的,由上诉书中的上诉声明和上诉理由决定,上诉请求决定着上诉审的审理范围,这是上诉请求拘束原则的内涵。上诉请求拘束原则要求上诉审的审理范围应止于对上诉理由的审理。上诉请求拘束原则包含上诉不利变更禁止原则和上诉有利变更禁止原则。我国《民事诉讼法》第13条、第168条以及《民诉法解释》第323条基本确立了上诉请求拘束原则,还应当增设附带上诉制度作为配套制度。劝阻吸烟猝死案中二审法院误判案件诉讼标的涉及公共利益,以当事人双方皆未主张的法律适用错误为由改判违反了上诉不利变更禁止原则。我国应当对处分权主义和职权探知主义适用的案件类型分别立法,不应在立案后判断案件诉讼标的是否涉及公共利益。The appeal is the subject of the appeal trial. The declaration of appeal and the grounds of appeal determine the scope of the appeal trial, which is the connotation of the restraint principle of appeal. The principle of restraint on appeal requires that the scope of the hearing of an appeal should be limited to the hearing of the grounds of appeal. The principle of restraint on appeal includes prohibition of alteration with prejudice and prohibition of alteration with interest. Article 13 and 168 of China’s Civil Procedure Law and Article 323 of the Interpretation of the Civil Procedure Law basically establish the principle of restraint on appeal, and a supplementary appeal system should be added as a supporting system. In the case of sudden death from discouraging smoking, the court of second instance misjudged that the subject matter of the lawsuit involves public interest. Changing the judgment on the grounds that both parties did not claim the wrong application of law also violated the prohibition of alteration with prejudice. China should legislate separately on the types of cases to which dispositionsmaxime or power-of-inquisition applies, and should not judge whether the subject matter of a case involves public interest after filing.
