论刑事证明标准中的客观性标准--以刑事补强证据规则为起点

摘　　要：随着刑事司法理论的发展,为保证定罪证明在形式与实质上的双重充分性,刑事证明标准逐渐吸收主观性标准形成了主客观相互配合的证明标准体系。在我国刑事证明标准的层次化构建中,由于受到广义刑事证明观与狭义刑事证明观的双重影响,阶段论者出现了观念上的暗自革转以及对客观性证明要求的忽视。由于我国立法本就暗含了主客观相结合的二元标准,一方面为摆脱后果主义的影响,避免因主观标准的外化不能而失去证明标准应有的指导意义;另一方面为避免将我国的刑事证明标准推向消极法定主义。刑事证明标准的层次化构建应当落脚于主客观相结合的二层次构建之上,并根据审查内容的不同选择不同的证明方法。With the development of criminal justice theory,in order to ensure the sufficiency of both the form and substance in terms of conviction proofs,the criminal proof standard gradually absorbs the subjective standard to form a proof standard system based on subjective and objective interactions.in the hierarchical construction of our country's criminal proof standard,due to the dual influence of the broad and narrow criminal proof views,stage theorists have secretly changed their ideas and neglected the requirements of objective proofs.our country's legislation inherently implies a dualistic standard that combines both subjectivity and objectivity.On the one hand,the legislation is to get rid of the influence of consequentialism and avoid losing the guiding significance of the proof standard due to the inability of subjective standards to be externalized.On the other hand,the legislation is to avoid pushing our country's criminal proof standards to passive legalism.the hierarchical construction of criminal proof standards should be based on a two-level construction pairing subjectivity with objectivity,and different proof methods should be selected according to diverse examination contents.
