摘 要:我国高校在“自主办学”的权限之下,可以对学生做出警告、给予处分、取消相关资格、退学等多种多样的惩戒行为。然而不同惩戒行为性质不明,以至于在实践中司法的审查限度不清,高校办学自主性的维护与学生权益的保护难以平衡。从规范的角度来看,惩戒行为可以被划分为《普通高等学校学生管理规定》中的“处分”类别、不授学位或不予毕业等“身份”类别以及日常教学惩戒等,其中的自主空间有所差别。在高校对学生的惩戒行为中,相关部门应注意司法介入时的合法性审查原则以及一定限度的合理性审查原则,并给高校留出其应有的自主办学空间,同时注重以多元的机制来面对高校中的惩戒纠纷问题。According to the authority of "independent school running" of colleges and universities in China,colleges and universities can make a variety of disciplinary actions on students,such as warning,punishment,cancellation of relevant qualifications,dropping out and so on.However,because the nature of different disciplinary actions is not clear,the judicial review limit in practice is not clear,and it is difficult to balance the maintenance of independent school running and the protection of students'rights and interests.From the normative point of view,disciplinary behavior can be divided into"Regulations on the Management of Students in Ordinary Colleges and Universities",such as"status"category of not conferring degree or not graduating,and daily teaching punishment,among which the autonomous space is different.In the discipline of college students,we should pay attention to the principle of legality review and a certain limit of rationality review in the judicial intervention,and leave space for colleges to run their own schools.At the same time,we should pay attention to multiple mechanisms to face the disciplinary disputes in colleges and universities.
