环境资源案件的恢复性司法探索——以平武法院审理滥伐林木案为例

摘　　要：课题组通过实证调研了解到,环境资源刑事案件是平武法院非常有特色的一类刑事案件。该法院设立巡回审判法庭形成了独特的司法模式。这一模式可以简单地描绘为:邀请更多主体参与诉讼程序,并提供互动的平台。在这个平台上,被告人与林业局等部门以“和解”“合作”的方式(包括通过被告人补植、林业局等部门监督执行的形式)影响诉讼结果。这样,不仅能够执行所判决的刑罚,又能实际修复受损生态环境,恢复生态功能,达到了惩罚为辅、教育为主和恢复环境生态的目的,还能教育和警示他人,最终实现法律效果、社会效果和生态效果的有机统一。通过对照西方恢复性司法和中国刑事和解制度(程序),课题组认为它是恢复性司法模式在中国的创造性运用,创造性在于其不仅仅有法院的积极主导,更有环保部门等主体的实质性参与。It is found from empirical research that environmental resource criminal cases tried by Pingwu Court is a very distinctive type of criminal cases.The court established a circuit court and formed a unique judicial model,that is,in⁃viting more subjects to participate in the litigation process and providing an interactive platform for them.The litigation re⁃sult is influenced by the ways of“reconciliation”and“cooperation”such as the defendant’s replanting of the destroyed trees under the supervision of forestry bureau or other departments,which not only the sentences imposed are executed but also the damaged ecological environment is repaired and ecological functions are restored,accomplishing the purpose of punishment supplemented by education and restoration of the environment and ecology.This unique judicial model also achieves the organic unity of legal,social and ecological effects by educating and warning others.Comparing the restorative justice system in the west with the Chinese criminal reconciliation system(procedure),it is concluded that the model is a creative application of restorative justice in China as it was not only actively led by the courts,but also substantively partici⁃pated by environmental protection agencies and other subjects.
