数字经济垄断下消费者福利标准的困境与转型

摘　　要：消费者福利标准因其可行性、经济性、确定性已成为反垄断法规制中竞争效果分析的重要工具。数字经济下,该标准的经济性、显性向非经济性、隐性福利转变。囿于传统消费者福利评价标准以价格损害为主,诸多行为可能无法评价为损害消费者福利,司法实践中该标准也存在价格损害隐蔽化、非价格损害无法量化的认定困境。应当立足于消费者本身,在多元价值因素的考量下构建权利型消费者福利体系,保障消费者的一般民事权利和反垄断法中特有的权利。同时修正传统价格维度的反垄断法分析范式,构建以反垄断法为主,民法、数据保护法、消费者权益保护法等法律为辅的综合保护路径,实现数字经济垄断下消费者福利标准的修正与转型。Because of its feasibility,economy and certainty,consumer welfare standard has become an important tool to analyze the competitive effect in antitrust practice.In the digital economy,the standard changes from economic welfare and explicit welfare to non economic welfare and implicit welfare.Due to the fact that the traditional evaluation standard of consumer welfare is mainly price damage,many behaviors may come to the conclusion that it does not affect consumer welfare.In addition,in judicial practice,consumer welfare has the dilemma that price damage is concealed and non price damage cannot be quantified.Starting from the consumers themselves,we should build a right based consumer welfare system,protect the general civil rights of consumers and the unique rights in the anti-monopoly law,and emphasize the consideration of multiple values.At the same time,standardize the boundary of data collection and use,fundamentally prevent the emergence of monopoly behavior,revise the analysis paradigm of traditional price dimension of anti-monopoly law,build a comprehensive protection path with anti-monopoly law as the main,civil law,data protection law,consumer rights and interests protection law as the auxiliary,and realize the correction and transformation of consumer welfare standards under the monopoly of digital economy.
