司法责任制下法官惩戒制度与监察制度衔接模式探析

摘　　要：为有效降低错案追究制给司法公信力带来的巨大负面效应,保障法官执业安全、精准惩戒法官违法犯罪行为,推动法官惩戒制度与监察制度合理衔接成为现阶段对法官惩戒的主要手段。惩戒主体界限模糊、惩戒事由不清、惩戒委员会依附性过强等都是我国法官制度中存在的问题。在此情形下,监察制度改革的基本完成有助于增强法官惩戒的有效性和执行力,同时法官身份的多重性及监察委员会外部监督的全覆盖性使二者有序衔接具有极大的必要性。从宏观构建上建立二者有效衔接就要明确惩戒主体、厘清惩戒事由、制定惩戒措施,从微观运行上做好启动、审查及认定程序。In order to effectively reduce the huge negative effect of the misjudged case investigation system on the judicial credibility,ensure the safety of the judge’s practice,accurately punish the judge’s illegal and criminal acts,and promote the reasonable connection between the judge’s punishment system and the supervision system,it has become the main means of the judge’s punishment at this stage.However,the problems of the judge system in China are that the boundary of the subject of punishment is vague,the cause of punishment is unclear,and the dependence of the punishment committee is too strong.In this case,the basic completion of the reform of the supervision system will help to enhance the effectiveness and execution of the judge’s punishment.At the same time,the multiplicity of the judge’s identity and the full coverage of the external supervision of the supervision committee make it necessary for the orderly connection of the two.To establish an effective connection between the two from the macro perspective,it is necessary to clarify the subject of punishment,clarify the cause of punishment,formulate punishment measures,and do a good job in the start-up,review and identification procedures from the micro perspective.
