破产法视野下的农民工劳动权保护问题探讨

摘　　要：农民工是我国现代化建设过程中不可或缺的劳动力,在企业破产程序中强调农民工劳动权的保护具有重大意义,是我国改革开放40多年成果的充分体现,体现了我国法律对农民工权益的保护,但对农民工的劳动权保护还需完善。农民工劳动合同签订率低,务工存在复杂性和多样性,因此在企业破产程序中应当确立对农民工劳动债权审理和认定中的倾向性保护原则。如果农民工提供的主张劳动关系的证据不充分,但管理人又无相反证据证明其与企业非劳动关系的,应当认定农民工与破产企业之间为劳动关系。农民工的劳动债权主体资格应当得到认定,管理人应当保护农民工的经济补偿金债权,也应当保护农民工的社会保险费债权,赋予农民工工资债权优先于有物的担保的债权及其他劳动债权受偿。The peasant-workers are indispensable labor forces in the course of modernization in China.It has significance of emphasizing the protection of labor rights of the peasant-workers in bankruptcy proceedings,which reflects the results of forty years of the reform and opening-up policy and the ultimate care for the peasant-workers of legislation.But the protection of labor rights of peasant-workers need to be improved.Because the rate of contract signing is low and the employment of peasant-workers exists complexity and variety,orientation of protective principle should be established for the labor rights of the peasant-workers'examination and affirmation in the bankruptcy procedure of enterprises.If proofs for proving labor relations are insufficient which the peasant-workers supply,but the bankruptcy administrators haven't proofs on the contrary,the bankruptcy administrators should recognize the relation of peasant-workers and bankruptcy companies as labor relations.The bankruptcy administrators should recognize the peasant-workers as the subject of labor creditor's rights.Also bankruptcy administrators should protect the creditor's rights of economic compensations and social insurance charges of the peasant-workers.The creditor's rights of payments of the peasant-workers should be given priority over secure claims and other labor creditor's rights.
