摘 要:2017年是高校职称评审权全面下放第一年,由于地方高校因在大学制度建设、职称评审经验等方面与教育部直属的重点高校有着诸多不同的特点,因而其在职称评审中凸显的问题尤其值得重视。当前,部分地方高校在职称评审时存在着促优汰劣及激励功能弱化、职称评审标准不够完善、评审责任追究难、评审程序不完善等问题。而这些问题产生的原因,一是监管信息与放权信息不对称使部分责任人不知法而违法,二是评审标准、程序不完善易误伤优秀从而降低其获得感,三是以往类案的过轻处罚易引发效仿带来不良影响,四是职称评审中的微腐败问题还未引起足够重视。为此,应树立软法亦法观念,加强职称法制宣传;加强职称评审相关软硬法建设,严惩职称评审中微腐败;完善职称评审制度,科学设置评审指标体系;完善职称评审程序,防范程序被动虚设;严抓监管并引入职称评审纠错机制;坚持依法治理和依德治理相结合,增强教师的获得感。2017 is the first year in which the right to evaluate professional titles in colleges and universities is fully delegated.Local colleges and universities have many different characteristics from the key colleges and universities directly under the Ministry of Education in terms of university system construction and professional title evaluation experience,so the problems highlighted in professional title evaluation should be paid special attention.At present,there are some problems in professional title evaluation in some local universities,such as promoting the excellent to eliminate the bad,weakening the incentive function,imperfect professional title evaluation standards,difficult to investigate the responsibility of evaluation,and imperfect evaluation procedures.The reasons for these problems are as follows:First,the asymmetry between the supervision information and the delegated information makes some responsible persons do not know the law but break the law.Second,the evaluation standards,procedures are not perfect easy to damage the excellent and reduce its sense of gain.Third,the excessively light punishment in previous cases is likely to lead to imitation and bring adverse effects.Fourthly,the micro corruption in the evaluation of professional titles has not attracted enough attention.Therefore,we should establish the concept of soft law as well as law and strengthen the publicity of legal system of professional title;Strengthen the construction of soft and hard methods related to title evaluation,and severely punish micro corruption in title evaluation;Perfecting the professional title evaluation system and setting up the evaluation index system scientifically;Improve the professional title evaluation procedure to prevent the passive falsification of the procedure;Strict supervision and introduction of professional title evaluation and correction mechanism;Adhere to the combination of the administration according to law and the administration according to morality,enhancing teachers'sense of gain.
