民事诉讼成本控制的域外考察与借鉴

摘　　要：合理的诉讼成本让人们接近正义,反之,则使司法成为高高在上的奢侈品。面对民事诉讼成本高的问题,20世纪下半叶的接近正义运动奠定了世界各国民事司法改革的基本方向:控制诉讼成本,提高诉讼效益。民事诉讼成本控制既具有促进公民有效行使诉权的作用,又具备实现经济合理性、保障司法机制良性运行的深意。为有效化解诉讼爆炸危机,控制诉讼成本,各国从调整诉讼费用以促使公民接近正义,广泛应用ADR以控制案件数量,优化诉讼程序以提高诉讼效率等方面进行改革,力图实现向控制范围系统性、控制过程有序性以及程序设置多元化的转变。我国有必要以推进民事司法现代化为契机,结合域外的先进经验,明确我国民事诉讼成本控制的功能定位与基本要求,通过多种方式控制民事诉讼成本,保证人们通过审判实现正义。Reasonable litigation costs bring people close to justice,and vice versa,make justice a luxury.Faced with the dilemma of excessively high civil litigation costs,the approach to justice movement that broke out in the second half of the 20th century laid the basic direction of civil judicial reforms in all countries:controlling litigation costs and improving litigation efficiency.The cost control of civil litigation not only promotes citizens'effective exercise of litigation rights,but also has the profound meaning of realizing economic rationality and ensuring the benign operation of judicial mechanisms.In order to effectively resolve the crisis of litigation explosion and control the cost of litigation,various countries have carried out reforms in terms of adjusting litigation costs to bring citizens closer to justice,widely using ADR to control the number of cases,and optimizing litigation procedures to improve litigation efficiency,so as to achieve a systematic control scope and process control.Orderliness and diversified changes in program settings.It is necessary for our country to take the opportunity of advancing the modernization of civil justice and combine the advanced experience of foreign countries to clarify the functional positioning and basic requirements of the cost control of civil litigation in our country,control the cost of civil litigation through various methods,and ensure that people can purchase justice through trial.
