论捕诉一体办案机制下审查批捕程序公开

摘　　要：推行“捕诉一体”的办案机制,对提高办案效率和节省办案人力资源方面亦具有一定的现实意义。在现有的审查批捕程序中仍存在批捕方式书面化、律师辩护职能没得到充分发挥、对被害人参与关注不够、批捕决定行政化的问题。检察机关应以内设机构系统性、整体性、重构性改革为契机,在明确刑事诉讼中审查批捕与审查起诉职能不同的基础上,注重二者在审查时间延续性、审查步骤与方法一致性、审查内容的前后衔接的相连关系,由此确立“捕诉一体”办案机制可行性、必要性。通过执行“捕诉一体”办案机制,有效探索一个符合我国司法实践,能满足审查批捕时限要求,律师辩护得到充分保障、被害人能依法参与的相对公开的审查批捕程序。从而强化刑事检察工作司法属性,将有益我国刑事诉讼法律制度发展。The implementation of the mechanism of“integration of arrest and prosecution”has a certain practical significance in improving the efficiency of handling cases and saving human resources.There are still some problems in the existing procedure of examining and approving arrest,such as the written way of approving arrest,not full play of the lawyer’s defense function,the lack of attention to the victim’s participation,and the administrative decision of approving arrest.Procuratorial organs should take the opportunity of systematic,holistic and reconstructive reform of internal organs.On the basis of clarifying the different functions of examination and approval of arrest and examination and prosecution in criminal proceedings,they should pay attention to the continuity of examination time,the consistency of examination steps and methods,and the connection of examination contents,so as to establish the feasibility and necessity of“integration of arrest and prosecution”mechanism.Through the implementation of this case handling mechanism,a relatively open procedure of examination and approval of arrest can be effectively explored,which is in line with China’s judicial practice to meet the requirements of the time limit of examination and approval of arrest,fully guarantee the lawyer’s defense,and the victim’s participation.Thus,strengthening the judicial attribute of criminal prosecution will benefit the development of China’s criminal procedure legal system.
