摘　　要：新时代背景下,应更加注重法的价值对于规范社会主体实现利益的作用。若沿循中西方法律思想将法的价值与利益相互联系的思考进路,视法为规范社会主体实现利益的工具,则其关键价值在于正义、自由与秩序。正义作为社会主体实现利益的“可能性”,不仅维护了其既有利益,同时也保障了其继续拥有实现利益的机会。自由作为社会主体实现利益的“可行性”,既确认了社会主体的生存资格,赋予了社会主体的发展动力,又提供了社会物质资料生产与交换的行动方式。秩序作为社会主体实现利益的“可得性”,能确保社会主体在遵循客观规律的基础上充分发挥主观能动性以实现利益。适时重解法的价值,可为满足人民日益增长的美好生活需要寻得法理依据,为平衡社会诸利益提供“三个自由”标准,也能为补齐生态秩序短板提供理由与方法。Under the background of the new era,more attention should be paid to the role of the value of law in regulating social subjects to realize their interests.If law is regarded as a tool to regulate social subjects to realize their interests,then its key values lie in justice,freedom and order.Justice,as a“possibility”for social subjects to realize their interests,not only protects their existing interests,but also ensures the opportunity to continue to realize their interests.Freedom,as the“feasibility”of realizing interests of the social subject,not only confirms the survival qualification of the social subject,endows the development power of the social subject,but also provides the mode of action for the production and exchange of social materials.Order,as the“availability”of social subjects to realize interests,can ensure that social subjects give full play to their subjective initiative to realize interests on the basis of abiding by objective laws.The timely reinterpretation of the value of law can find a jurisprudential basis for urban and rural residents to satisfy the growing expectations for a better life,provide a standard of“three freedoms”to balance the interests of the society,and also provide reasons and methods to make up for the shortcomings of the ecological order.
