摘　　要：对未成年人的特殊关爱是一个社会文明程度的重要体现,而未成年人法律体系是司法文明的一个重要组成部分。本文拟从比较法的视阈出发,综合运用实证分析、历史分析、比较分析等方法论,通过研究我国未成年人刑事法律制度发展现状,同时对照域外的少年司法制度的发展进程,总结我国未成年人刑事法律制度的发展特点,为构建我国未成年人法律体系提供借鉴,同时针对我国目前在未成年人刑事法律制度方面存在的空白和困境,探索前景与出路。The special care for minors is an important embodiment of the degree of social civilization, while the legal system of minors is an important part of judicial civilization. From the perspective of comparative law, this paper comprehensively uses the methodology of empirical analysis, historical analysis and comparative analysis to study the current situation of the development of China’s juvenile criminal legal system, and summarizes the development characteristics of China’s juvenile criminal legal system in comparison with the development process of foreign juvenile justice system, so as to provide reference for the construction of China’s juvenile legal system. At the same time, in view of the gaps and difficulties existing in the criminal legal system of minors in China, this paper explores the prospects and outlets.
