摘　　要：双轨制少年司法模式是以少年司法制度的运行机制为标准,将非行少年事件的处理方式划分为保护程序以及刑事司法程序的少年司法模式。双轨制少年司法模式的特点表现为少年法院管辖的广泛性、保护程序审理的特殊性以及非行少年处遇的非刑罚性。双轨制少年司法模式建立在深厚的法学理论基础之上,不仅其表露出的“平衡”的法律思想值得学习,制度上的设计与衔接上的精妙更是值得我国在构建少年司法制度中进行借鉴与参考。The dual-track juvenile justice model is based on the operating mechanism of juvenile justice system,the handling of Delinquent Juveniles are divided into protection procedures and criminal justice procedures.The characteristics of the dual-track juvenile justice model are the universality of jurisdiction of juvenile court,the particularity of the trial of protective procedure and the non-penal penalty.The dual-track juvenile justice model is built on the basis of profound legal theories,which is not only worth learning from the"balanced"legal thoughts it reveals,but also worthy of reference in the construction of juvenile justice system in China through the exquisite design and connection of the system.
