摘　　要：在调解程序中,司法确认是确保调解协议获得法律效力的重要程序,文章通过对多元解纷机制的建设与发展的论述来揭示我国司法确认制度的现实困境。目前,司法确认程序中存在关于管辖法院的规定模糊、与执行程序衔接不畅等问题,据此,文章提出细化管辖法院的相关规定、建立与执行程序衔接机制等措施,以期完善调解协议的司法确认制度。In the mediation process,judicial confirmation is an important procedure to ensure the legal effect of mediation agreement.This paper discusses the construction and development of multiple dispute resolution mechanism to reveal the realistic dilemma of judicial confirmation system in China.At present,there are some problems in the judicial confirmation procedure,such as vague provisions on the jurisdiction court and poor connection with the execution procedure.Therefore,this paper puts forward some measures,such as refining the relevant provisions of the jurisdiction court and establishing the connection mechanism with the execution procedure,in order to improve the judicial confirmation system of mediation agreement.
