民事执行异议之诉问题研究

摘　　要：民事执行异议之诉是实体性执行救济制度,在实践中与普通民事诉讼制度相互吸收排斥,与民事审判监督、民事执行监督之间密切关联,司法实践容易认知不一、适用混淆。厘清民事执行异议之诉与其他相关民事程序界限,确定关联程序的“连接点”,才能明确民事执行异议之诉受案范围的除外情形:担保人、优先权人要求停止对标的物执行的异议、公司要求停止执行股东在公司股权的异议、债权人对于执行法院不同意其参与分配所提异议及其他三种特殊情形的异议,逐帧完善民事执行异议之诉制度。The lawsuit of civil execution objection is the substantive execution relief system.In practice,it absorbs and repulse each other with ordinary civil proceedings,and is closely related to civil trial supervision and civil execution supervision system.In judicial practice,it is easy to raise different cognition and application confusion.Only by clarifying the boundary between the litigation system of objection to civil execution and other civil procedures,and determining the“connection point”with related procedures,can we make clear the following matters do not belong to the scope of the execution objection lawsuit:the objection of guarantors and priority holders to the execution of the subject matter,the company’s objection to the execution of the shareholders’equity in the company,the creditor’s objection to the execution court’s disapproval of its participation in distribution and the other three special cases of objection.The civil execution objection litigation system shouib be improved step by step.
