摘　　要：个人信息具有公益属性,可以成为检察监督权行使的对象。检察机关通过提起个人信息保护检察公益诉讼,能够对滥用公民个人信息的行为形成有效规制。检察公益诉讼法律法规的可扩张性和试点以来检察公益诉讼较为成熟的实践经验,使得个人信息保护领域适用检察公益诉讼具备可行性。具体适用路径可通过完善检察公益诉讼诉前、诉中程序,赋予检察机关调查取证权,适用过错推定责任原则实现举证责任倒置,采取建立检察机关与行政机关之间证据、信息共享的双向互动机制等方式将检察公益诉讼适用范围拓宽至个人信息保护领域。以此加强对侵犯公民个人信息行为的法律规制,加快对公益诉讼适用范围的探索和突破,确保公益诉讼制度发挥实效。Personal information has the attribute of public welfare,which can become the object of the exercise of procuratorial supervision power.Procuratorial organs can effectively regulate the abuse of personal information by instituting public interest litigation for the protection of personal information.Procuratorial public interest litigation in the field of personal information protection is feasible because of the expansibility of procuratorial public interest litigation policies and regulations and the mature practice accumulation of procuratorial public interest litigation since the pilot.The specific way to to expand the scope of procuratorial public interest litigation to cover the field of personal information protection is to improve the public interest litigation procedures and regulations,give the procuratorial organs the right to investigate and collect evidence,apply the principle of presumption of fault,reasonably distribute the burden of proof,and establish a two-way interactive mechanism of evidence and information sharing between procuratorial organs and administrative organs.In this way,strengthen the legal regulation of the infringement of citizens’personal information,speed up the exploration and breakthrough in the new field of public interest litigation,and ensure the effectiveness of public interest litigation.
