新《民事证据规定》关于司法鉴定费用的规定及反思

摘　　要：新《民事证据规定》对鉴定费用的预收、鉴定人出庭费用的负担及计算标准、鉴定费用的退还等内容进行了系统的规定。这对解决司法实践中的鉴定费用争议以及促使鉴定人积极履行鉴定义务具有一定的积极作用。但关于鉴定人出庭费用的计算标准、依职权启动鉴定程序的费用预交、退还鉴定费用等规定还是存在一些问题。因此,构建科学合理的鉴定费用规范,就需要采取相应的改革和完善措施,诸如完善司法鉴定援助,制定合理的鉴定人出庭费用标准,厘清鉴定中各方主体之间的诉讼法律关系,调整鉴定费用的预交期间,等等。The new provisions on civil evidence systematically stipulate the contents of the advance collection of the appraisal fee, the burden and calculation standard of the appraisal fee, and the refund of the appraisal fee, which has a certain positive effect on solving the dispute of the appraisal fee in judicial practice and encouraging the appraisal obligation to be performed actively.In spite of this, there are still some problems in the regulation of the calculation standard of the cost for the expert to appear in court, the advance payment of the cost to start the appraisal procedure according to the authority, and the refund of the appraisal fee.Therefore, constructing scientific and reasonable appraisal charge standard, you need to take corresponding measures to reform and perfect, such as perfecting the judicial authentication aid, to establish a rational standard of the expert witness to appear in court costs, clarify the legal relations between parties the identification of main body, adjust the appraisal charge during the period of accepting the and so on, in order to further perfect our system of civil judicial appraisal fees, promote the function of identification.
