认罪认罚从宽制度中“认罚”辨析

摘　　要：认罪认罚从宽制度中的“认罪”与“认罚”存在一定的逻辑关系,在进行“认罚”评价时,不能将二者割裂开来。“悔罪”虽属“罪”的范畴,但仍是“认罚”评价的重要指标。当罪名发生变化时,需要被追诉人重新认罚。不能将财产刑的执行作为评价“认罚”的标准,从而人为限制认罪认罚从宽制度的适用。在被追诉人认罚的情况下,仍可作量刑辩护,尤其是辩护人在整个程序中均可作量刑辩护。侦查和调查阶段的“认罚”具有概括性和模糊性,不宜从严要求,应结合“认罪”进行反向考察。二审阶段上诉人“认罚”是对一审量刑建议的认可,若检察机关未提出量刑建议,可以一审裁判为准,对于发回重审的案件,一概禁止认罪认罚从宽制度的适用,似有违“上诉不加刑”原则。There is a certain logical relationship between"plead guilty"and"acceptance of punishment"in the lenient system of pleading guilty and accepting punishment.In the evaluation of"acceptance of punishment",the two should not be separated.Although"repentance"belongs to the category of"crime",it is still an important index of"acceptance of punishment"evaluation.When the charge changes,the accused needs to be re-punished.The execution of property penalty can not be regarded as the criterion to evaluate"acceptance of punishment",so as to limit the application the lenient system of pleading guilty and accepting punishment.In the case of the accused person's acceptance of punishment,the defence of sentence may still be used,especially by the defender throughout the procedure.The"acceptance of punishment"in the investigation stage is general and fuzziness,should not be strictly required,but should be combined with the"plead guilty"to carry out a reverse investigation.At the second instance stage,the appellant's"acceptance of punishment"is the approval of the first instance sentencing proposal.If the procuratorial organ does not put forward the sentencing proposal,the first instance decision shall prevail.For the case remanded for retrial,if the application of the lenient system of pleading guilty and accepting punishment is prohibited,it seems to violate the principle of"no additional punishment on appeal".
