摘  要:行政诉讼被告拒不执行生效裁判时,向来以法院强制执行作为基本的执行模式,但这种模式在实践中遭遇了“强制不能”的困境。近些年一些地方在完成“基本解决执行难”目标下,结合自身实际探索出一种法院与其他主体协作执行的“协作执行模式”,取得了良好的效果。但协作执行尚未形成统一的标准,各地差异很大,类型也较为多样。从理论与现实的角度对多种类型进行审视后,可以认为法院与政府协作执行的模式是最好的选择。这种执行模式在我国具备坚实的理论基础,也更具现实可行性。为实现长效解决执行难,最终目的则是通过立法实现其制度化。When a defendant in an administrative lawsuit refuses to enforce a decision,the basic enforcement model has always been court enforcement,but this model has encountered the dilemma of“inability to enforce”in practice.In recent years,under the goal of“basically solving the difficulties in enforcement”,some places have explored a“collaborative enforcement model”in which the court and other entities collaborate to enforce the law,which has achieved good results.However,the collaborative enforcement has not yet formed a unified standard,and varies greatly from place to place,and the types of collaborative enforcement are also quite diverse.After examining the various types from a theoretical and practical perspective,the model of collaborative enforcement between the courts and the government is the best choice.This enforcement model has a solid theoretical foundation and is more realistic and feasible in China.The ultimate goal is to institutionalize it through legislation in order to achieve a long-term solution to enforcement difficulties.
