摘 要:夫妻约定不动产“归一方所有”在性质上属于夫妻财产制契约而非赠与合同,属于夫妻约定财产制范畴,故应受夫妻财产法的管辖。夫妻财产制契约遵循债权意思主义下的物权变动规则,即对内可直接产生物权变动效果,使约定的不动产物权在夫妻之间发生移转;对外则采公示对抗制度,非经登记不得对抗善意第三人。唯有如此,才能在维护夫妻财产制度的同时避免复杂的夫妻财产关系危及市场交易安全,进而实现社会整体利益的提升。The agreement of a couple on the real estate belonged to one party should be identified as marital property contract instead of gift contract,and should be regulated by the Marriage Law.The legal effects of marital property contract should be mentioned in two dimensions.For internal effect,the real right has been altered;for outer effect,the alternation cannot challenge the bona fides third party.Thus,the autonomy of individual,the integrity of Marital Law and the transaction security are all under consideration,and the overall interests of our whole society would be improved significantly.
