摘　　要：商会组织在不同社会文化中发展出不同样态,理论上我们将其作为经济治理的一种机制,与市场和国家等其他治理机制形成替代和互补关系。我国商会起源甚早,发展过程漫长而曲折,虽在改革开放后有较大发展,但与域外商会相比,仍有一些差距。商会带有天然的公共属性,并以此为发挥功能的基础。为实现商会的核心价值,体现商会市场公器之效能,在全面依法治国的背景下,应当尽快推进商会立法工作,完善社会主义市场经济法律体系,引导商会制度的发展与改革方向。保持开放的姿态吸纳整合,让商会通过立法走向前台,是深化改革和发展经济的必然要求,也是对构建“共建共治共享”社会格局的贡献和回应。The development of Industry Associations and Chambers is different in different social cultures.Theoretically,we regard it as a mechanism of economic governance,forming a substitution and complementary relationship with other governance mechanisms such as the market and the state.China’s Industry Associations and Chambers has a long and tortuous history.Although it has a great development after the reform and opening up,there are still some gaps compared with foreign chambers of Commerce.The Industry Associations and Chambers has a natural public attribute,which is the basis of its function.In order to realize the core value of Industry Associations and Chambers and reflect the efficiency of Industry Associations and Chambers’s market instruments,we should promote the legislation of Industry Associations and Chambers as soon as possible.It is an inevitable requirement for deepening reform and economic development to maintain an open attitude,absorb integration and let the Industry Associations and Chambers go to the front stage through legislation,it is also a contribution and response to the construction of the social pattern of“sharing benefits through collaboration and joint governance”.
