南非图书馆版权例外制度分析及启示

摘　　要：南非版权法律制度要本地化、图书馆业务需进一步发展,助推了南非图书馆版权例外制度的完善。南非图书馆版权例外制度经历了漫长的转型时期,目前它涵盖图书馆文献传递、馆际互借、信息资源保存备份、促进教育和学术活动、促进残疾人获取信息等基本内容,为图书馆的发展提供了比较全面的支持。我国《版权法》第三轮修订之际可以借鉴南非的经验,扩大图书馆保存作品的范围、增设文本与数据挖掘的版权例外、完善数字教育和学术的版权例外、增设为残疾人提供数字服务的版权例外、通过立法鼓励开放获取、积极建立跨领域合作机制,促进图书馆业务的开展并保障公众获取信息和知识权利的有效实现。As the copyright legal system in South African needs to be localized and the library business needs to be further developed,it led to the improving of copyright exception system for South African libraries.The copyright exception system for South African libraries has gone through a long transition period,and now it covers document delivery,interlibrary loan,information resource preservation,promoting educational and academic activities,and access to information for people with disabilities,which provides more comprehensive support for the development of libraries.In the third revision process of the Copyright Law of the P.R.C.,it’s necessary to learn from South Africa to expand the range of works kept in the library,set the copyright exception of text and data mining,improve the copyright exception of digital education and academics,set the copyright exception of digital service to the disabled,encourage open access,and establish interdisciplinary cooperation mechanism to promote the development of librarianship as well as ensure the effective realization of public access to information and knowledge.
