摘　　要：分析探讨基因编辑技术所带来的法律与伦理问题,认为应确定人类胚胎的法律地位,区分“基因治疗”与“基因增强”两范畴及其不同的规制要求,同时加强公众参与并完善知情同意制度。This paper analyzes and discusses the legal and ethical issues brought about by gene editing technol⁃ogy,and concludes that the legal status of human embryos should be determined,gene therapy and gene enhance⁃ment should be differentiated and their different regulatory requirements should be made,and public participation should be strengthened and informed consent system should be improved.
