摘  要:根据我国《著作权法》规定,出版者权的客体为版式设计,实际上将出版者权的保护对象限定于智力劳动,既将出版者为传播作品付出的资金、组织等劳动排除在外,不符合出版者权的保护实践,还与其他三类邻接权客体的设置模式不一致。遗憾的是,2020年11月11日审议通过的《著作权法》未对出版者权客体的规定进行修改。既然出版者权属于邻接权的类型之一,那么应按邻接权制度的基本理论来界定出版者权的本质属性和客体范围。从制度产生的根源看,邻接权属于作品传播者权,其保护的客体是作品的传播成果。因此,出版者权亦应是为全面保护作为作品传播者的出版商的利益而创设的法律制度,其保护的客体应为出版者为传播作品所付出的劳动的最终呈现形式,即出版物制品。At present,China’s Copyright Law stipulates the object of publisher’s rights as layout design,which actually limits the protection of publisher rights to intellectual labor.It excludes the funds,organization and other labor paid by the publisher for dissemination of works,and it does not conform to the protection practice of publisher’s rights,and it is also inconsistent with the setting mode of the other three types of neighboring rights objects.Unfortunately,the Copyright Law reviewed and passed on November 11,2020 did not modify the provisions of the object of publisher’s rights.Since the publisher’s right belongs to one of neighboring rights,the essential attributes and object scope of the publisher’s rights should be understood and defined according to the basic theory of the neighboring rights system.From the perspective of the roots of the system,neighboring rights belongs to the right of the communicator of works,and the object of its protection is the achievement of the works.Therefore,the publisher’s right should also be a legal system created to fully protect the interests of publishers who are the communicators of works,and the object of its protection should be the final form of work that the publishers have paid to spread the works,that is,publication products.
