行政公益诉讼中检察机关调查核实权的界定

摘　　要：行政公益诉讼中调查核实权的强制性不足造成调查取证难问题普遍存在,而部分地方的改革实践则将调查核实范围予以不当扩展。上述问题产生的根源在于立法对调查核实权的界定过于模糊,造成其属性、强制性、与行政公益诉权的关系和行使范围的不确定。依现行宪法的规定,检察机关是专门的法律监督机关,这也决定了调查核实权应界定为有限的法律监督权,表现为调查核实权以《人民检察院组织法》第21条为全部规范依据,是行政公益诉权的派生性权力,调查的范围应限于核实公益诉讼案件相关情况。调查核实权的强化也应立足于有限监督权这一定位,通过适当放宽行政公益诉讼的立案标准、完善举报机制、建立与监察部门的衔接机制等方式予以强化。In administrative public interest litigation,the coercive deficiency of investigative power causes the difficulty of obtaining evidence.Simultaneously,reform practice in some places improperly expands the scope of investigation and verification.The root cause of the above-mentioned problems lies in the fact that the legislative definition of the power of investigation and verification is too vague,resulting in the uncertainty of its attributes,coercion,relationship with administrative public interest litigation power,and the scope of exercise.According to the provisions of the 1982 Constitution,the procuratorial organ is a specialized legal supervision organ,which also determines that the power of investigation and verification should be limited legal supervision power.This power is defined as a derivative power of the administrative public interest litigation right on Article 21 of the Organization Law of the Procuratorate.The scope of the investigation should be limited to verifying the relevant circumstances of public interest litigation cases.The enhancement of the power of investigation and verification should also be based on the positioning of limited supervision power,strengthened by appropriately loosening the standards of administrative public interest litigation,improving the reporting mechanism,and establishing a linking mechanism with the supervision department.
