摘 要:考察近七年司法实践中的数据,发现老年人犯罪和被害案件逐年递增,折射出老年刑事法制教育的缺位。老年刑事法制教育作为终身法制教育的最后一环,存在社会重视程度不够、教育方式和内容缺乏针对性、教育责任主体单一等问题。为预防老年人犯罪及被害,老年刑事法制教育应增强针对性和有效性,发挥“新乡贤”在基层的引导和管理作用,辅之心理教育、政策教育等其他社会教育,最终构建以家庭为本位以及个人、社会、国家“四位一体”的法制教育责任模式。Based on the data of judicial practice in the past seven years,it is found that the number of crimes and victims of the elderly is increasing year by year,which reflects the absence of criminal legal education for the elderly.As the last link of lifelong legal education,the criminal legal education for the elderly has some problems,such as insufficient social attention,lack of pertinence in educational methods and contents,and single subject of educational responsibility.In order to prevent the elderly from committing crimes and being victims,we should enhance the criminal legal education for the elderly in its pertinence and effectiveness,give full play to the guiding and management role of“new rural sages”at the grass-roots level,supplement it by psychological education,policy education and other social education,and finally build a family oriented legal education responsibility model with the integration of individual,society and state.
