对于民事诉讼专家辅助人出庭意见采信规则研究的评述

摘　　要：民事诉讼专家辅助人这一角色的出现对于保障我国民事诉讼活动正确实施具有推进作用。我国学者们对于民事诉讼专家辅助人出庭意见采信规则的研究已经有了初步的研究成果,但是对于其多学科理论分析框架的综合运用以及规则构成等方面的研究还具有很大的拓展空间。中国民事诉讼法,应以保障司法公正为根本要求,建构适用于中国本土化的专家辅助人出庭意见采信规则的制度体系。The appearance of the role of auxiliary person of civil litigation experts has a promoting effect on ensuring the correct implementation of civil litigation activities in China.Chinese scholars have already made preliminary research results on the rules of court opinion and acceptance of civil litigation experts,but there is still a lot of room for the comprehensive application of their multidisciplinary theoretical analysis framework and the composition of rules.China's civil procedure law should be based on the protection of judicial justice as the fundamental requirement,the construction of the application of China's localization of expert auxiliaries to the court opinions of the rules of the system.
