摘　　要：互联网文化产业以其新的技术属性、产业特征对传统政府规制体系,进行着“规制突破”,形成了“横向融合”的产业特征与“纵向分立”的规制体系之间的对立,造成了对产业链重点环节的规制与“非线性”发展的矛盾,以及导致了规制主体“把关”能力的分散化等问题。互联网文化内容规制必须适应产业横向分层、融合发展,以及去中心化等一系列新的特征,综合调整政府规制的思路、框架、机构及举措。在明确政府规制合法性的基础上,探索构建横向分层的规制总体框架、建立独立融合的规制机构,同时充分发挥各主体自治能力,形成复杂的互联网文化生态系统的适应性规制举措。With its new technical attributes and industrial characteristics,the Internet cultural industry is making a“regulatory breakthrough”in the traditional government regulation system.It has formed the conflict between the industrial characteristics of“horizontal integration”and the regulation system of“vertical separation”,leading to the decentralization of the“check”ability of regulatory subject caused by the contradiction between industrial division and non-lineal development as well as the“decentralization”of content production.Internet cultural content regulation must adapt to a series of new characteristics such as horizontal stratification,integrated development and decentralization of industry,and comprehensively adjust the ideas,framework,institutions and measures of government regulation.On the basis of clarifying the legitimacy of government regulation,it is necessary to explore the adaptive regulation measures of building a horizontal hierarchical regulatory framework,establishing independent and integrated regulatory institutions,and giving full play to the autonomy of each subject to form a complex Internet cultural ecosystem.
