摘 要:本文从解释论的角度出发,根据当前法律、司法解释和有关规范性文件的规定及司法实践,对建设工程价款优先受偿权与其他权利的清偿顺位作了较为全面的梳理,并提出了自己的见解。具体而言,非消费者的物权期待权和不动产的预告登记均不能对抗建设工程价款优先受偿权;在债务人破产时,承包人享有优先受偿权的建设工程也属于破产财产,为实现该优先受偿权而产生的破产费用和共益债务(含税款)应优先于该优先受偿权清偿,但该优先受偿权的清偿顺位应优先于其他担保物权、经预告登记的债权请求权及其他破产费用和共益债务(含税款);对于不动产已经转让的情形,在第三人善意的情况下,应承认建设工程价款优先受偿权的追及效力。From the perspective of interpretation theory and in accordance with the current law,judicial interpretation,related regulatory documents,and judicial practice,this article comprehensively studies the payment sequence of priority of compensation for construction project price and other rights,and also provides the author’s own opinions.To be specific,non-consumer’s ownership contingent right and the advance notice registration of real estate can not resist against priority of compensation for construction project price;When debtor goes bankrupt,the construction project for which the contractor enjoys priority of compensation is also bankrupt property,bankruptcy expenses and obligatory right of common benefit(including tax)which incurred from realizing the priority of compensation shall be compensated prior to the priority of compensation,but the payment sequence of the priority of compensation shall precede over other real rights,right to petition of obligatory rights with advance notice of registration,and other bankruptcy expenses and obligatory right of common benefit(including tax);When real property has already been transferred,if the thirdparty is bona fide,the pursuing effect of the priority of compensation for construction project price shall be acknowledged.
