摘  要:战国末期,由于宗法封建制度的解体,传统的刑德共治的国家治理思想架构解体,而法制思想呼之欲出。韩非子充分地吸收了儒家、道家和墨家的国家治理思想,创立了人人皆自利(人人皆望誉冀利)的人性论,建立了道、理、德相应的道用论形而上学,并创立了以其人性论和道用论为根基的法、术、势相统一的法制思想。韩非子法制思想对当时宽漫无边、闳大迂阔的德治思想具有纠偏作用。韩非子法制思想对于现代法治建设具有重要意义:首先,现代法治建设要重视人性恶的问题;其次,现代法治建设要重视本体论思想的构建;再次,现代法治建设要把法律作为现代法治的核心;最后,现代法治建设必须营造与之相应的法治文化氛围。At the end of the Warring States Period,due to the disintegration of patriarchal feudal system,the traditional framework of national governance jointed by rule of punishment and morality was disintegrated,and the thought on rule by law was about to emerge.After Han Feizi fully absorbed the thoughts on national governance of Confucianism,Taoism and Mohism,he created the theory that human nature is self-interest and that metaphysics of functional Tao that Tao,reason and morality are mutually corresponding.Meanwhile he initiated that law,art and power are unified based on his theory of human nature and functional Tao.Han Feizi’s thought on rule by law rectified overuse of rule by virtue at that time.Firstly,the construction of modern rule of law should consider the evil nature of humans.Secondly,we should attach importance to the construction of ontology in the construction of modern rule of law.Thirdly,the construction of modern rule of law should take law as the core of modern rule of law.Lastly,the construction of modern rule of law must create a corresponding cultural atmosphere of rule of law.
