消费信贷市场算法信用评分的消费者保护问题研究

摘  要:算法信用评分在消费信贷市场迅速兴起,不仅颠覆了传统信用评分方式、催生出新的金融市场主体、促进消费信贷的普惠性,还对消费者保护尤其是隐私和自主权保护提出了挑战。为了在鼓励消费信贷市场创新与消费者保护之间取得平衡,英国以保护消费者隐私和自主权为导向,通过消费信贷和数据保护等法规来实施消费信贷市场算法信用评分领域的消费者保护。通过归纳总结英国经验,结合我国实际情况提出应完善算法信用评分领域消费者保护工作架构、明确高标准的消费者隐私和自主权保护要求、对消费者数据处理周期实行早期介入和监管、加强数据保护知识公众宣传教育等建议。The rapid rise of algorithmic credit scoring in the consumer credit market has not only overturned traditional credit scoring methods,spawned new financial market bodies,and promoted the inclusiveness of consumer credit,but also posed challenges for consumer protection,especially privacy and autonomy protection.In order to strike a balance between encouraging innovation in the consumer credit market and consumer protection,the UK takes the protection of consumer privacy and autonomy as the guide,and implements consumer protection in the area of consumer credit market for algorithmic credit scoring through consumer credit and data protection regulations.By summarizing the experience of the United Kingdom,this article proposes to improve the structure of consumer protection in the field of algorithmic credit scoring,clarify high standards of consumer privacy and autonomy protection requirements,implement early intervention and supervision of consumer data processing cycles,and strengthen data protection based on the actual situation of China and provide recommendations for public awareness and education on the protection of knowledge.
