摘　　要：司法确定力与司法管辖范围的文化选择密切关联,科学技术和经济文化的发展给人们带来了更多的选择机会,推动社会权利意识和法律的发展,为司法管辖范围和司法确定力的扩张提供了观念动力;在自由价值发展基础上形成的权利体系和法律安排为司法管辖范围和司法确定力的发展指明了方向;建立在文化选择基础上的司法管辖范围决定了司法确定力的影响范围;通过文化选择形成的司法管辖权架构决定了司法确定力的实现路径。法律事实建构的文化评价对司法确定力的形成具有重要影响,作为裁决依据的法律事实是发现和建构的真实图景,在这种文化认识基础上形成的司法确定力是绝对确定力和相对确定力的结合;作为裁判依据的法律事实是司法公正价值和司法效率价值有机结合的产物,在此文化选择基础上形成的司法确定力是理想确定力和现实确定力的整合;作为裁判依据的法律事实是法律正义和社会正义的有机结合,在此文化评价基础上形成的司法确定力是内在确定力和外在确定力的融合。司法确定力源自审判规则建构的文化整合,法院通过立法民意与司法民意的融合、法律价值与社会价值的整合、法律价值冲突的消解形成审判规则的确定力。司法裁判结果的文化取向也深刻影响司法确定力的形成基础,司法确定力集中体现为司法裁判结果的文化影响力,其表达了同案同判的文化诉求,内含了法律效果与社会效果相统一的文化认同意识。Judicial certainty power is closely related to the cultural choice of scope of judicial jurisdiction.The development of science,technology,economy and culture brings people more choices,promotes the development of social rights consciousness and law and provides the conceptual impetus for the expansion of scope of judicial jurisdiction and judicial certainty power.The right system and legal arrangement formed on the basis of the development of freedom value point out the direction for the development of scope of judicial jurisdiction and judicial certainty power.The cultural choice of scope of judicial jurisdiction determines the scope of influence of judicial certainty power.The cultural choice of the distribution of jurisdiction determines the realization path of judicial establishment.The cultural evaluation of the construction of legal facts has an important influence on the formation of judicial certainty power.As the basis of ruling,legal facts are the real picture that has been discovered and constructed.The judicial certainty power formed on the basis of this cultural understanding is the combination of absolute certainty and relative certainty.The legal fact as the basis of judgment is the product of the organic combination of judicial justice value and judicial efficiency value.The legal fact as the basis of judgment is the organic combination of legal justice and social justice.The judicial certainty power comes from the cultural integration of the construction of trial rules,and the certainty power of trial rules is formed by the integration of legislative public opinion and judicial public opinion,the integration of legal value and social value,and the resolution of the conflict of legal value.The cultural orientation of judicial judgment results also has a profound impact on the foundation of judicial certainty power.Judicial determination is reflected in the cultural influence of judicial judgment results.Judicial certainty power contains the cultural appeal that the similar cases lead to the simil
