摘  要:以问卷、走访等方式对四川省×市的医疗纠纷调解实践进行调查。结合调解工作实践,分析该市医疗纠纷调解现状、调解机构组织设置、人员设置与结构、调解流程、调解案件基本情况以及患方最关注的问题和纠纷解决选择路径。提出医疗纠纷调解存在调解机构缺乏宣传、调解员年龄结构不合理、调解形式色彩严重、人员专业背景缺失以及缺乏患者信任等现实困境,并有针对性地提出改善机构知晓程度、调整人员年龄结构、增加有专业背景的调解员,建立调解员继续教育机制、明确告知义务、加强调解实质化建设以及建立事后总结机制等优化路径。This study investigates the practice of medical dispute mediation in a city in Sichuan Province by means of questionnaires and visits.Combined with the practice of mediation,this paper analyzes the current situation of medical dispute mediation,the organizational setting of mediation institutions,personnel setting and structure,mediation process,the basic situation of mediation cases,as well as the problems most concerned by patients and the choice of dispute resolution path.Combined with the actual situation,it is proposed that there are practical difficulties in medical dispute mediation,such as the lack of publicity of mediation institutions,unreasonable age structure of mediators,serious bias of mediation forms,lack of professional background of personnel and lack of trust of patients.Targeted suggestions are put forward to improve the awareness of institutions,adjust the age structure of personnel,increase mediators with professional background,and establish a continuing education mechanism,clarify the obligation of disclosure,strengthen the substantive construction of mediation and establish an afterwards summary mechanism.
