深化医疗纠纷多元化解决机制研究——以山西省为例

摘　　要：研究山西省近十年来医疗纠纷处理途径的特点,为多元化协同解决提供路径。分析2010年~2020年法院判决书、2015年~2019年卫生行政机关和2014年~2020年人民调解统计资料,医疗纠纷长期处于高发态势,人民调解发挥了诉源防控的关口作用,是多元化纠纷解决机制的连接点。建立诉前调解对接、疑难案件联动、司法确认衔接、医疗纠纷研判、联席会议、委托调解、学习培训、信息互联共享、指导和报告、纠纷预警对接、重大社会影响案件协助化解等具体制度,深化和完善多元化纠纷解决机制。This article studies the characteristics of the medical dispute settlement methods in Shanxi Province in the past ten years to provide a path for diversified coordinated resolution.It analyzes the statistics of court judgments from 2010 to 2020,health administrative agencies from 2015 to 2019,and people mediation from 2014 to 2020.Medical disputes have not been unusual for a long time,and people mediation has played a critical role in preventing and handling medical disputes.It is a connection to the diversified dispute resolution mechanism.To deepen and improve the diversified dispute resolution mechanism,we need to work on pre-litigation mediation and connection,knotty case linkage mechanism,and judicial confirmation linkage,medical dispute study,joint meetings,commissioned mediation,learning and training,information interconnection and sharing,guidance and reporting,dispute early warning and connection,assistance in resolution of major social impact cases,etc.
