人体器官买卖的刑法规制研究——法律伦理主义视角下的分析

摘　　要：人体器官买卖缘起于医学临床上供体器官来源严重匮乏所引发的对人体器官的强烈需求。在伦理上,人体器官买卖是一种严重违背人类生命伦理的反社会行为;而在法律上,人体器官买卖则是一种应当受到刑罚惩治的犯罪行为。我国现行立法意识到了人体器官买卖的社会危害性,并以刑法修正案的形式增设了"组织出卖人体器官罪"这样一种人体器官买卖犯罪,但这一犯罪无法全面有效地规制人体器官买卖。伴随着人体器官买卖在我国的渐愈显化,有必要进一步修改刑法,扩展刑法对人体器官买卖犯罪的打击范围。The sale of human organs derives from the urgent requirement of organs in medical surgery brought by the lack of donors.In bioethics,human organ sale is a conduct against community,which deeply infringes human’s bioethics.While in law,it is a crime which needs criminal punishment.The enforcing China’s Criminal Law has realized the social danger of human organ sale and stipulated the new crime of organizing of human organs by means of an amendment for Criminal Law.Yet such a crime couldn’t regulate the sale of human organs comprehensively.With the aggravation of human organ sale in China,the scope of the Criminal Law should be expanded aginst the crime of the sale of human organs.
