数据驱动型经营者集中的审查困境及对策建议

摘　　要：在数字市场,数据驱动型经营者集中的现象日渐增多,横向、纵向与复合集中交织,协议集中为主要形式,资本和大数据平台是集中的主要推动者。数据驱动型经营者集中引发的数据垄断效应明显,如违规收集和共享用户数据,对用户和新入者设置新的市场壁垒,降低用户的隐私保护力度等。加大对数据驱动型经营者集中的审查具有必要性,在审查过程中应以潜在竞争者认定和替代能力分析不能等同、审查介入与行业发展不冲突、监管与审查不影响竞争中立等为基本理念。数据驱动型经营者集中的审查正面临着前瞻性缺失、传统相关市场界定理论失灵及经营者申报标准滞后等困境。因此,为了完善数据驱动型经营者集中的审查机制,在分析竞争效果时应注重消费者福利原则,创新相关市场界定标准及认定方式,适用大数据必要设施原则,推进申报标准的多元化创新,合理设定集中的附加条件。In the digital market,the phenomenon of data-driven operator concentration is increasing.Horizontal,vertical,and compound concentration are intertwined,among which protocol concentration is the main form,and capital and big data platforms are the main drivers of concentration.The data monopoly effect caused by the concentration of data-driven operators is obvious,such as collecting and sharing user data in violation of regulations,setting new market barriers for users and new entrants,and reducing user privacy protection.It is necessary to increase the review of data-driven operator concentration.In the review process,the basic concepts should be that the identification of potential competitors and the analysis of alternative capabilities cannot be equal,the intervention of the review should not conflict with the development of the industry,and the supervision and review should not affect the neutrality of competition.The review of data-driven operator concentration is facing dilemmas such as lack of foresight,failure of traditional relevant market definition theories,and lagging declaration standards for operators.Therefore,in order to improve the review mechanism for data-driven operator concentration,we should pay attention to consumer welfare principles when analyzing the effects of competition,innovate relevant market definition standards and identification methods,apply the principle of necessary big data facilities,promote diversified innovation of declaration standards,and reasonably set additional conditions for concentration.
