摘　　要：目前的死刑复核程序具有"审查方式行政化"和"全面审查一刀切"等特点,司法实践中最高法院不予核准死刑的案件,并非主要是因事实不清或者证据不足,死刑复核阶段审查事实问题的作用有限。以审判为中心的刑事诉讼制度改革和认罪认罚从宽制度的确立,为新时期死刑复核程序的完善提供了有利的条件和机遇,可以根据被告人认罪认罚和所持异议等情况,对死刑案件进行分流化处理,构建死刑复核程序的分层化机制。对死刑案件中非事实问题的审查,可以继续采取书面审查和讯问被告人的方式进行;而对事实仍然存有异议的死刑案件,由原审法院或者最高法院指令的其他法院予以审理。最高法院不对事实问题进行审查,将查清事实的问题下沉至中级人民法院或者高级人民法院,这与最高法院的职能定位相契合。The current death penalty review procedure has the characteristics of "administration" and "comprehensiveness". In judicial practice, the case in which the Supreme Court does not approve the death penalty is not mainly due to unclear facts or insufficient evidence. The role of examining factual issues in the death penalty review stage is limited. The reform of the criminal procedure system centered on trial and the system of leniency upon admission of guilt and acceptance of punishment provides favorable conditions. According to the defendant,s confession and objection, the case can be treated differently and the stratification of procedure for review of death penalty can be constructed. The examination of non-factual issues in death penalty cases may continue to be conducted by means of written examination and interrogation of the accused;while death penalty cases that still have objections to the facts shall be tried by the court of original trial or other courts ordered by the Supreme Court. The Supreme Court does not examine the issue of facts, but sinks the problem of finding out the facts to the intermediate people’s court or the higher people’s court, which is consistent with the functional orientation of the Supreme Court.
