摘　　要：随着《监察法》的实施和反腐败工作的深入,我国反腐败工作取得了举世瞩目的成效。中国特色的反腐败机制已经形成。同时,对监察人员的监督问题也备受关注,刑法对监察人员犯罪规制的问题值得研究。例如,对监察人员职务犯罪的一些罪名,因监察人员的主体身份问题而难以通过刑法定罪;监察人员妨害调查的行为难获刑法规制;再如,如何通过刑法对监察人员的职务行为展开监督,以期避免“灯下黑”的难题,《监察法》的“纪法融合”与《刑法》的“职务犯罪追诉一元化”理念存在冲突等。着重探讨监察人员职务犯罪的刑责追究障碍及对策问题,通过刑法解释、刑法修订、加强检察机关的外部监督和引入刑法“追诉犯罪一元化”理念等方式,针对监察人员职务犯罪“法法衔接”的缺失问题展开研究,以期将相关理论付诸于实践。With the implementation of The Supervision Law and the deepening of anti-corruption work,China's anti-corruption work has achieved remarkable results and the anti-corruption mechanism with Chinese characteristics has been formed.At the same time,the supervision of supervisors has come in the spotlight,and the criminal regulation of supervisors is worth studying.For example,some charges of duty crime against supervisors are difficult to be convicted by the criminal law because of their subject identity;it is difficult for supervisors to be regulated by the criminal law for breach of investigation;how can the supervisors'duty behavior be inspected through the criminal law in the hope of avoiding the problem of“being dark under the light”;there exist conflicts between the“integration of discipline and law”of the supervision law and the“unified prosecution of duty crimes”of the criminal law,and so on.This paper focuses on the obstacles and countermeasures of calling the supervisors to account for their criminal liability by taking advantage of duty.By interpreting the criminal law,amending the criminal law,strengthening the external supervision of the procurators and the introduction of the concept of“unified prosecution of crimes”in the criminal law,the study has been conducted on the lack of“legal convergence”of the duty crimes committed by the supervisors,so as to put the relevant theories into practice.
