摘　　要：监察体制改革后,各级监察委员会作为行使国家监察职能的专责机关,依照《监察法》对所有行使公权力的公职人员进行监察,调查职务违法和职务犯罪。《刑事诉讼法》则保留了检察机关在对诉讼活动实行法律监督中发现的司法工作人员利用职权实施的非法拘禁等侵犯公民权利、损害司法公正的犯罪的立案侦查权。厘清监察调查管辖与检察侦查管辖的分工,探讨互涉案件的牵连管辖,完善管辖竞合的衔接机制,对预防和惩治司法工作人员职务犯罪,健全国家监察监督与检察法律监督体系,十分迫切和重要。After the reform of supervision system,the supervision committees at all levels are the specialized agencies to exercise national supervisory functions.They supervise all public officials who exercise public powers in accordance with the Supervision Law,and investigate duty violations and crimes.The revised Criminal Procedure Law reserves the right to file and investigate crimes that violate civil rights and impair judicial fairness,such as illegal detentions by judicial staff who were found to be illegally detained by judicial personnel during the legal supervision of litigation activities by procuratorial organs.Clarifying the division of labor between the jurisdiction of supervisory investigation and the jurisdiction of procuratorial investigation,discussing the jurisdiction of interrelated cases and improving the cohesion mechanism of jurisdictional competition are very urgent and important to prevent and punish judicial staffs’duty crimes and improve the national supervisory supervision and procuratorial legal supervision system.
