摘  要:知性思维把正义理解为自然的、普遍永恒的、实体化的价值标准和建制一种符合这一标准的社会安排。知性思维试图用正义秉性的应得、规范二重原则来统一正义内涵的道德、法权二重维度,认为应得证成了何为正义这一理念范畴,规范做成了何以正义这一经验事实,但却无力解释正义在个体与公共、内容与形式间结构性的二重分裂。在辩证逻辑的批判意境中,反思知性正义观的逻辑方法和历史内容,能够揭示正义秉性和结构中的二重悖论。正义不是以应得来规范道德和法权,不是某种价值标准的实体化,而是超越以应得为理念范畴的,不断反思应得(何为正义)和规范(何以正义)的前提依据,进而是批判这些前提依据的一种历史性的关系范畴和过程环节。Intellectual thinking understands justice as a necessary,natural,universal,eternal,objective standard of value and a social arrangement that conforms to this standard. Try to use cognitive thinking,standard double due to principles of justice that being unified justice the connotation of morality and the double dimension of law. That is justice concept category,specification made into why the empirical fact of justice,but was unable to explain the justice in the individual and the public,structural double split between content and form. In the critical conception of dialectical logic,reflecting on the logic method and historical content of the view of intellectual justice can reveal the double paradox of the nature of justice and its structure. Justice is not the standardization of moral and legal rights with due,nor the materialization of a certain value standard. It is a historical dimension and process link that goes beyond the concept of due,constantly reflects on the premise basis of due(what is justice)and norm(how is justice),and then criticizes these premise basis.
