英国精神障碍患者非自愿医疗制度及其启示

摘　　要：在英国,精神障碍患者的非自愿医疗包括入院评估、入院治疗和紧急情况下的入院评估等多种类型,且法律对各种类型的非自愿医疗均规定了相应的适用条件和程序。同时,对于患者的非自愿入院,英国没有采取西方国家盛行的司法审查制度,而建立了独具特色的精神卫生审查裁判所制度作为事后救济途径。英国独特的非自愿医疗制度对我国具有一定的借鉴意义,如多元化的非自愿医疗体系、充分有效的事后救济机制、完备的非自愿住院决定的制约机制等。In the United Kingdom,involuntary medical care for patients with mental disorders includes admission assessment,admission treatment,and admission assessment in emergencies,corresponding applicable conditions and procedures for various types of involuntary medical care are stipulated in the laws as well.Besides,the judicial review system that prevails in western countries for the involuntary admission of patients is not implemented,instead,a unique mental health review tribunals system has been established as a means of post-event relief in the United Kingdom.The unique involuntary medical system in the United Kingdom has specific reference significance for China,such as a diversified involuntary medical system,a fully effective post-event relief mechanism,and a complete restriction mechanism of involuntary hospitalization decision,etc.
