摘　　要：舞蹈作品独创性判断是作品构成与侵权认定的逻辑前提。舞蹈作品独创性表达内容应是舞蹈动作的设计与编排,且其独创性的核心应体现在舞蹈结构与舞蹈构图。舞种数量、舞者人数及不同组合形式亦可作为舞蹈作品独创性的重要参考要素。艺术价值评价、单个舞蹈动作和舞蹈辅助性元素应排除于舞蹈作品独创性的判断范围。The judgment of the originality of dance works is the logical prerequisite for the composition of the work and the identification of infringement.The original expression content of dance works should be the design and arrangement of dance movements,and the core of its originality should be reflected in the dance structure and dance composition.The number of dance types,the number of dancers and different combinations can also be used as important reference elements for the originality of dance works.The evaluation of artistic value,single dance movements and auxiliary dance elements should be excluded from the scope of judgment of the originality of dance works.
