摘　　要：公共部门数据信息对公民、企业和其他组织参与公共社会生活和公共决策有重要意义,欧盟于2019年7月修订了《公共部门信息再利用指令》,而后将其更名为《开放数据与公共部门信息再利用指令》。修订后的指令纳入了一系列新规定,将适用范围扩大至公共事业数据和公共资金资助产生的研究数据,推动建立高价值数据集,保持数据再利用的低费用,并且防止公共部门与私营机构达成排他性协议。我国目前只制定了政府信息公开制度,尚未制定公共部门信息再利用制度,也未明确指出公共部门信息的知识产权归属及与信息再利用之间的协调安排。因此,可在借鉴欧盟公共部门信息再利用制度修订经验的基础上,厘清公共部门信息再利用制度与知识产权制度间的关系,制定出符合我国国情的公共部门开放数据和信息再利用制度。Public sector information is of great significance for citizens,enterprises and other organizations to participate in public social life and public decision-making.In July 2019,the European Union revised the Directive on Re-use of Public Sector Information,which is renamed as the Directive on Open Data and the Re-use of Public Sector Information afterwards.The revised directive includes a series of new provisions which extend the scope of application to public undertaking data and research data generated by public funding,promote the establishment of high-value datasets,maintain low cost of data re-use,and prevent exclusive agreements between public sectors and private partners.At present,China has only formulated the government information disclosure system,but has not formulated the public sector information reuse system,and has not clearly pointed out the intellectual property ownership of public sector information and the coordination arrangement concerning information reuse.Therefore,based on the experience of EU’s revision of public sector information reuse system,we should clarify the relationship between the systems of public sector information reuse and intellectual property,and formulate the public sector open data and information reuse system in line with China’s national conditions.
