摘 要:近年来,生态文明领域由党政联合发文的形式启动重大改革,已逐步呈现常态化的趋势。法典需要具有稳定性的特征。一般认为,党政联合规范性文件具有外部效力,并且具有“党规”与“国法”的双重性质。这决定了环境法典编纂中必须处理与生态文明领域党政规范性文件的关系。环境法典的稳定性、难以变动性及修改程序的复杂性决定了与党政规范性文件之间衔接的困难。党政规范性文件与单行法之间的衔接更具可能的条件和实践优势。环境法典编纂须直面这一难题。In recent years,the mode that major reforms in the field of ecological civilization were started through the party-government jointly-issued normative documents has gradually shown a trend of normalization.A code needs to have the characteristic of stability.It is generally believed that the party-government jointly-issued normative document have external effect and dual nature of"Party regulation"and"national law".This determines it necessary to deal with the relationship between the Environmental Code and the party-government jointly-issued normative documents in the field of ecological civilization during the coding process.The stability,difficulty in alteration and complexity in amendment procedures of the Environmental Code determine the difficulty in its connection with the party-government jointly-issued normative documents.The connection between party-government jointly normative documents and seperate Laws may be more possible and have practical advantages.The compilation of Environmental Code needs to face up to this challenge.
