行政法学抑或警察法学--我国警察行政法学科属性探析

摘　　要：我国警察行政法研究从体系选择上究竟应当依托于行政法学抑或警察法学是其自身理论体系架构的起点问题。当前,警察行政法是否属于特别行政法存在一定探讨空间,将警察行政法划归入警察法学科体系也面临较大争议。从法理层面分析,警察行政法学以警察行政权研究为核心,但由于权力主体分离状况的存在,警察行政权与国家行政权的相容关系并不能完全地折射到学科属性的研讨空间中。Whether the study of police administrative law should be based on administrative law or police law is the starting point of its own theoretical system.At present,as for whether the police administrative law belongs to the special administrative law,there is still room for discussion.The classification of police administrative law into the police law discipline system is also facing considerable controversy.From the perspective of legal theory,the law on police administration is centered on the study of police executive power.However,due to the separation of power subjects,the compatible relationship between police administrative power and state administrative power can not be completely reflected in the research space of disciplinary attributes.
